1. ACCEPTANCE OF TERMS

By accessing or using the services provided by AffiStudio ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

These terms apply to all visitors, users, and clients who access or use AffiStudio's services including game development, game reskin, app development, website development, and monetization consulting.

2. SERVICES OFFERED

AffiStudio provides the following services:

  • Custom Mobile Game Development (Unity 3D / 2D)
  • PC Game Development for Steam
  • Game Reskin using premium Unity templates
  • Android Application Development
  • Website Design and Development
  • Monetization Consulting (AdMob, IAP strategy)

The scope, deliverables, and timelines for each project will be discussed and agreed upon before the project begins.

3. PAYMENT TERMS

  • All prices are quoted in Indian Rupees (₹) unless otherwise stated.
  • A 50% advance payment is required before work begins on any project.
  • The remaining 50% is due upon delivery of the final product.
  • For larger projects, payments may be structured based on milestones agreed upon beforehand.
  • We accept payments via UPI, Bank Transfer, and Razorpay.
  • All payments are non-refundable once work has commenced, except as described in our Cancellation & Refund Policy.

4. PROJECT DELIVERY

  • Estimated timelines are provided at the start of each project and may vary depending on project complexity and client responsiveness.
  • Delays caused by incomplete information or assets from the client's side will extend the delivery timeline accordingly.
  • AffiStudio will make reasonable efforts to deliver projects on time but does not guarantee exact delivery dates unless specified in a written agreement.

5. INTELLECTUAL PROPERTY

  • Upon full payment, the client receives complete ownership of the source code and project files delivered.
  • AffiStudio retains the right to showcase the completed project in its portfolio unless a Non-Disclosure Agreement (NDA) is in place.
  • Any third-party assets, libraries, or templates used in the project remain subject to their original licenses.
  • The client is responsible for ensuring they have valid developer accounts (Google Play Console, Steamworks) for publishing.

6. REVISIONS AND CHANGES

  • Each project includes a reasonable number of revisions as discussed during the project scope.
  • Major scope changes or additional features requested after project approval may incur additional charges.
  • All changes must be communicated clearly via email or WhatsApp and confirmed by both parties.

7. CLIENT RESPONSIBILITIES

The client agrees to:

  • Provide all necessary assets (logos, images, text, branding materials) in a timely manner.
  • Respond to queries and provide feedback within a reasonable timeframe.
  • Ensure they have the legal right to use any materials they provide to us.
  • Maintain valid developer accounts on platforms where their product is published.

8. WARRANTIES AND DISCLAIMERS

  • AffiStudio provides services on an "as-is" basis.
  • We do not guarantee specific download numbers, revenue, or rankings for published apps or games.
  • Post-launch support is included as per the selected plan (30–60 days) and covers bug fixes, not new features.
  • AffiStudio is not responsible for issues caused by third-party platforms (Google Play, Steam, AdMob, etc.).

9. LIMITATION OF LIABILITY

AffiStudio shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with our services. Our total liability for any claim shall not exceed the amount paid by the client for the specific project in question.

10. TERMINATION

  • Either party may terminate a project by providing written notice.
  • If the client terminates the project, payments made up to that point are non-refundable for work already completed.
  • AffiStudio reserves the right to terminate a project if the client fails to provide necessary assets or payments despite repeated reminders.

11. GOVERNING LAW

These Terms and Conditions are governed by the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Punjab, India.
